<ndufresne> narmstrong, Hans can't really enforce the rule, it's more a wish, CODA as an example does not have the firmware there, it's been under discussion with NXP for over 5 years
<ndufresne> but NXP never released the binary under GPLv2, probably the most silly thing to do legally
<ndufresne> one motivated user could sew them to get the code

<narmstrong> ndufresne: the FW doesn't necessarily needs to be GPLv2, it only has to have a clear redistribution licence, other WiFi firmware have quite restrictive licence, but are allowed to be redistributed in the linux-firmware repo
<ndufresne> narmstrong, what I'm saying is that CODA was merge and the firmware is not there, b43 wifi driver is also merged, there is some "open source" firmware now, but it was merged before that, and the open firmware don't work most of the time
<ndufresne> they also staged Tegra 2 codec, firmware is not included
<ndufresne> there is zillion of case where the driver got merged before the firmware legal was solved
<ndufresne> (even case where the legal will never be solved)
<ndufresne> narmstrong, what I would do is submit the patchset with the promise that you are making best effort to get these legal issue solved

<ndufresne> then we should make a case at the next media summit
<ndufresne> keeping code out of tree for this reason makes collaboration on the main goal (the driver) impossible
